Municipal Court

 

Nablus Municipality Court has been founded in 1986 in response to the Israeli military order number 631 during the Israeli Civil Administration. The court judge is appointed by the magistrate court to settle all incoming verdicts delivered by the municipality. The staff comprises of Chief of Clerks, Accountant (treasurer), informer, two clerks and one janitor. The court examines all verdicts/violations against municipal laws sued by the municipality against violators within its jurisdiction and among its areas of authorization such as:

• Violating of Municipalities’ law number 29 of 1950.
• Violating of town-planning land buildings’ law number 79 of 1966.
• Violating of crafts’ law number 16 of 1953.
• Violating of measurement law number 8 of 1953
• Violating of trees and plants law number 85 of 1966.

The court holds two-weekly sessions and it is responsible for executing all verdicts and collects respective fines within certain procedures of the penal law. These fines are being incorporated in the municipality treasury. The verdicts are revised thoroughly by the General Attorney for further appeal if necessary. The Municipal jurisdiction is similar to that of the magistrate court for processing the penal trials. A general attorney is nominated by the mayor to represent the Municipality court. The final penal judgement is issued by the magistrate court for further appeal purposes. Among objectives for finding the municipality court is to be specialized in settling all issues sued only by the municipality, expediting process and executing all decisions according to the laws.
